These Regulations consolidate provisions previously contained in the Control of Pollution (Anglers’ Lead Weights) Regulations 1986 (S.I. 1986/1992) and the Control of Pollution (Anglers’ Lead Weights) (Amendment) Regulations 1993 (S.I. 1993/49), both of which are revoked by regulation 6. The Regulations apply in England only. Subject to certain exceptions, regulation 3 prohibits the supply of lead in the form of lead weights (as defined by regulation 2) for the purpose of weighting fishing lines, and creates a rebuttable presumption that a person supplying split shot does so for the purpose of weighting fishing lines. The offence is punishable on summary conviction with a fine (regulation 5). A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen. These Regulations were notified in draft under Directive 98/34/EC (as amended).
