Explanatory note

This Order establishes a development Council for the potato industry in Great Britain to be known as the British Potato Council. In particular the Order— a assigns functions to the Council (article 3 and Schedule 1); b provides for the appointment of members and the proceedings of the Council (articles 4 and 5 and Schedule 2); c provides for the keeping of a register of producers and first purchasers (articles 6 and 7); d empowers the Council to require registered producers and first purchasers to furnish returns and information (articles 8 and 11); e provides for the imposition of charges by the Council for its expenses in the exercise of its functions (article 9); f empowers the Council to borrow and invest money (article 10); and g prescribes offences and penalties (article 12). This Order comes into force on the day after the day on which it is made.

The noble Lord said: My Lords, the British Potato Council was established in May 1997 under the provisions of the Potato Industry Development Council Order 1997. Its statutory functions can be summarised as commissioning or assisting research and development, collection and dissemination of statistical and marketing information, the development of exports and generic promotion of potatoes including seed potatoes.

The Potato Industry Development Council, known as the British Potato Council, is an executive non-departmental public body. It was established by the Potato Industry Development Council Order 1997, under the provisions of the Industrial Organisation and Development Act 1947. It exists to commission potato research and development; to transfer technology: to collect and disseminate market information and to promote potatoes in the UK and overseas markets.
